2. The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 213 of 2023 registered for the offence punishable under Sections 8(c), 21(b) and 22 of the NDPS Act.

3. As per the prosecution case, there is recovery of 7.880 gms. of smack from the Varandah of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and the said recovery is of intermittent quantity. The petitioner is in custody since 20.03.2023 having clean antecedent.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.34002 of 2023(5) dt.01-11-2023 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 213 of 2023, subject to the condition that the petitioner will co-operate in the trial.
