1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 385, 307, 379, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 30.03.2024 and is alleged to have assaulted the injured by iron katta causing injury on head. It is next submitted that the injury suffered by the injured is simple in nature as would manifest from the order impugned. It is also submitted that the parties have compromised the case on intervention of well wishers. It is next submitted that the blow was not repeated
Patna High Court CR. MISC. No.35845 of 2024(2) dt.20-09-2024 2/2 even, which amply demonstrates that petitioner never had any intention of committing a serious occurrence.
4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
5. Considering the submission made by the learned counsel appearing on behalf of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Waris Nagar P.S. Case No. 80 of 2023.
6. Accordingly, the instant regular bail application stands allowed.
