JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-03-2015 The petitioner is in custody since 15.9.2014 in relation to Dariyapur P.S.Case No. 1/70 (G.R. 1590/70, Trial No. 19 of 2014) pending before the Chief Judicial Magistrate, Chapra instituted under Sections 324, 379 and 323 of the Indian Penal Code.
From 1970 to 2010 the petitioner was in attendance. After 40 years of the trial allegedly the petitioner absconded and has now been apprehended. Merely on the ground of long abuse the Sessions Court has rejected the bail of the petitioner. Considering the facts and circumstances, let the petitioner Jai Prakash Tiwary be released on bail on furnishing bail bond of Rs.5,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Dariyapur P.S.Case No. 1/70 (G.R. 1590/70 & Trial No. 19/2014).
