The petitioners are apprehending their arrest in connection with Nimchak Bathani P.S.Case No.79 of 2017 dated 18.6.2017 , registered for offences punishable under Sections 366(A) of the Indian Penal Code.
Allegation against the petitioners and other accused persons is of kidnapping of the minor daughter of the informant. Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case as a matter of fact they are father, mother and sister of one Nitish Kumar; with whom she has love affair and in her statement under Section 164 Cr.P.C. she has only stated that she was taken and
Patna High Court Cr.Misc. No.1306 of 2019(2) dt.18-01-2019 2/2 kept at Patna in his house and no other overtact has been alleged against the petitioner or the other accused person. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Xth, Gaya in connection with Nimchak Bathani P.S.Case No.79 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..
With the aforesaid observation, this application is allowed.
