2. The petitioner is in custody in connection with Saharsa Sadar P.S Case No. 62 of 2023 registered for the offences punishable under Sections 399, 402 of I.P.C and Section 25(1-b)a, 26, 35 of the Arms Act.

3. As per prosecution case, one loaded country made pistol and one live cartridge were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that co-accused have already granted bail

Patna High Court CR. MISC. No.35850 of 2024(2) dt.21-05-2024 2/2 by the Co-ordinate Benches of this Court vide order dated 07.02.2024 and 27.03.2024 passed in Cr. Misc. No. 5135 of 2024 and Cr. Misc. No. 19764 of 2024 respectively. It is also submitted that petitioner is in judicial custody since 30.01.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M, 1st Class, Saharsa in connection with Saharsa Sadar P.S Case No. 62 of 2023.
