The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 307/379 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have assaulted the informant by the back side of the spade causing him injury on the shoulder.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and the injury caused by him has been found to be simple in nature. There is bona fide land dispute between the parties due to which altercation took place. Petitioner has claimed clean antecedent and he is in custody since 31.3.2021. Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.43795 of 2021(3) dt.28-02-2022 2/2 petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Madhubani town Police Station Case No. 118 of 2020.
