In such view of the matter, this application against the petitioner no.2 is dismissed as withdrawn.
So far petitioner no.1 (Sarsawati Devi @ Surti Devi @ Sursati Devi) is concerned, she is apprehending her arrest in connection with Sahebganj P.S.Case no.375 of 2018 dated 12.10.2018, G.R No.3560 of 2018 , registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. It is submitted that she is mother-in-law and the case is of dowry death. No specific allegation has been attributed against her and the whole family members have been made accused in this case.
Patna High Court Cr.Misc. No.1680 of 2019(2) dt.01-02-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner no.1 (Sarsawati Devi @ Surti Devi @ Sursati Devi) , above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Ist, West Muzaffarpur in connection with Sahebganj P.S.Case No.375 of 2018 dated 12.10.2018 G.R.No.3560 of 2018, subject to condition as down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
