JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,307/34 of the Indian Penal Code and 27,30 of the Arms Act. As per allegation in the F.I.R, a Barat party came at the house of Ram Sidhi Singh@ Doma Singh. Petitioner and three other persons were made HURSH firing with country made pistol and on firing one Ashmin Khatoon sustained bullet injury in her shoulder.

Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. The victim has sustained injury on her hand not the vital part of the body and the victim has not lodged the F.I.R against the accused persons

Patna High Court CR. MISC. No.43958 of 2021(4) dt.23-03-2022 2/2 and the complaint made by Chaukidar. Petitioner has got clean antecedent.

Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioner, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Bhojpur at Ara in connection with Chauri P.S.Case No. 52 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
