JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 29.7.2020 in connection with Bhagwan Bazar P.S. Case No. 338 of 2020 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Two hundred forty litres countrymade liquor was recovered from a vehicle which was being driven by the petitioner. The first information report goes to show that aforesaid liquor belonged to co-accused Baban Rai and so far as the petitioner is concerned, he was only driving the said vehicle. Although, the petitioner does have antecedents of similar nature of cases but considering the period of detention of the petitioner in jail custody as well as above stated facts and circumstances,

Patna High Court CR. MISC. No.32096 of 2020(3) dt.25-01-2021 2/2 let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 338/2020.
