JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-02-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner namely Md. Hasbul is in custody since 09.07.2014 in Forbesganj P.S. Case No. 303 of 2014 u/s 302/201/34 of I.P.C.

According to the prosecution case, the daughter of the informant was married with one Md. Islam and subsequently, when Md. Islam went outside in connection with his livelihood, the present petitioner got illicit relation with the daughter of the informant and married her. Then the informant learnt that the petitioner has murdered the daughter of the informant and threw the dead body.

Patna High Court Cr.Misc. No.45649 of 2014 (2) dt.04-02-2015 The learned counsel for the petitioner submitted that only on suspicion, the informant has lodged the F.I.R. There is no eye witness. The petitioner is a married person. He has got children and, therefore, there is no question of marrying the daughter of the informant arises.

Considering the nature of allegation and the period of detention and the fact that there is no eye witness according to the prosecution case, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.5,000(five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 303 of 2014. (Mungeshwar Sahoo, J) Saurabh/- U T
