JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Earlier the petitioners were granted anticipatory bail vide order dated 18.04.2017 passed in Cr. Misc. No. 16811 of 2017 with condition that they shall cooperate in the investigation of the case and approach the informant for handing over the charge and if she is not ready, then they will hand over the charge to the District Co-operative Officer. Submission of learned counsel for the petitioners is that as they were not aware about the charge handed over, as such the aforesaid condition could not be complied with and for this modification petition has been filed.

Having heard both sides, in view of the facts and

No.19 of 2019(2) dt.16-01-2019 2/2 circumstances of the case, it appears that this modification application has been filed after almost one and half years of passing of the order, as such, I am not inclined to interfere in the order dated 18.04.2017 passed in Cr. Misc. No. 16811 of 2017, however, the petitioners will surrender and make prayer for regular bail and the court below after considering the fact that the petitioners have earlier granted privilege of anticipatory bail, shall dispose of the matter, if possible, on the same day.
