====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 22-08-2023 Heard Mr. Md. Ataul Haque, learned counsel appearing on behalf of the petitioner and Mr. Uday Prasad, learned AC to GP-22 for the State.

2. Learned counsel appearing on behalf of the petitioner submits that during the pendency of the writ petition, the office of the provident fund has verified the period during which contributions were made and the same has been communicated to the Executive Engineer, Building Construction Department, Sarharsa, but the petitioner has not been paid the amount of G.P.F.

3. Considering the submission made by learned counsel on the basis of counter affidavit filed on behalf of

Patna High Court CWJC No.9117 of 2022 dt.22-08-2023 2/2 respondent nos. 4 and 5, the Executive Engineer, Building Construction Division, Saharsa is directed to take immediate steps for making payment of required amount of G.P.F. to the petitioner with respect to the contributions made during the period from 1982-83 till 2013-14 within a period of two weeks.

4. The petitioner, if so advised, may file a fresh representation for making payment of other retiral dues which has not been paid till date. In case, the petitioner files the representation, the District Magistrate, Saharsa is directed to call for the service records relating to the petitioner from the office of the Executive Engineer, Building Construction Division, Saharsa and ensure to make payment of remaining dues as claimed by the petitioner along with statutory interest within a period of six weeks from the date of filing of the representation.

5. The writ application stands disposed of.

6. Office is directed to place on record the hard copy of the supplementary counter affidavit filed on behalf of respondent nos. 4 and 5 today in the Registry along with the records of the present writ writ application which has been disposed of.
