The petitioner seeks bail in Makhdumpur P.S.

Case No. 258 of 2013 registered under section 307 and other allied sections of the Indian Penal Code.

The informant named 11 persons and alleged that when his nephew went to uproot the flag from his field the accused persons brutally assaulted him.

Learned counsel for the petitioner submits that there is omnibus and general allegation of assault. The injured got seven injuries on head and other parts of body but the injuries are simple in nature. Co-accused Umesh Prasad has already been enlarged on bail vide rder passed in Cri. Misc. No. 39062 of 2014.

No.5511 of 2015 (2) dt.10-02-2015 2/2 Considering the fact that omnibus and general allegation of assault is made against the petitioner and similarly situated co-accused Umesh Prasad has already been granted bail the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-3, Jehanabad in Makhdumpur P.S. Case No.258 of 2013.
