JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chandauti P.S. Case No. 152 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 and 506 of the Indian Penal Code. Allegation is that accused persons, including the petitioner call the deceased and thereafter several accused persons assaulted him, causing his death.
Submission of learned counsel for the petitioner is that though he is named in the FIR but there is no allegation of assault against him and other co-accused has been granted bail vide order dated 16.1.2019 passed in Cr.Misc.No. 2192 of 2019. Heard learned APP and learned counsel for the informant, who is drawing my attention towards FIR showing that the petitioner is the person who had called the deceased and
Patna High Court Cr.Misc. No.78895 of 2018(4) dt.14-02-2019 2/2 thereafter he and other accused persons assaulted him. Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if the petitioner surrenders and makes prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
