JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 16.06.2020 in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition & Excise Act.

In huge quantity liquor was recovered from vehicle in which petitioners are said to be found sitting. However, learned counsel of the petitioners submits that

Patna High Court CR. MISC. No.32031 of 2020(2) dt.09-12-2020 2/2 petitioners do not have any concerned with the vehicle as well as seized liquor and they were caught by the police on mere suspicion. It is also stated that petitioners do not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, cum Special Judge, Excise, Aurangabad, Bihar in connection with Amba P.S.Case No. 37 of 2020.

It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioners shall be deemed to be confirmed.
