Heard learned counsel for the petitioner as well as learned APP.
Gone through the report submitted by learned lower court wherefrom, it is apparent that out of five witnesses three are yet to be examined. Petitioner happens to be under custody since 25.04.2014 having an allegation to have entice away the victim, Savita Kumari @ Nanhki Kumari. At an earlier occasion, prayer was withdrawn under Cr.Misc.No.31454/2014 (Annexure-1). The victim had shown inclination towards the petitioner, however, she happens to be a minor.
In the aforesaid facts and circumstances as well as taking into account the period of detention, petitioner Prem
Patna High Court Cr.Misc. No.8042 of 2015 (4) dt.05-08-2015 Manjhi @ Negda Manjhi is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Assistant Sessions Judge-II, Jamui in connection with S.Tr.No.161/2014 arising out of Sono PS Case No.186/2013, subject to the condition that petitioner will not influence upon the victim till conclusion of the trial, failing which the learned lower court will be at liberty to pass appropriate order in accordance with law.
