====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Bihta P.S. Case No. 793 of 2018 corresponding to Sessions Trial No. 365 of 2019, registered for the offence punishable under Sections 147, 148, 149, 448 and 302 of the Indian Penal Code and section 27 of the Arms Act.

Earlier, bail application of the petitioner was rejected vide order dated 17.07.2019. This is second attempt. Earlier vide order dated 08.12.2020, report regarding stage of trial was called for and the same has been received and kept at flag 'Y'. From perusal of report, it appears that five witnesses have already been examined and only Doctor and Investigating Officer are to be examined.

Patna High Court CR. MISC. No.32822 of 2020(3) dt.19-01-2021 2/2 Considering the stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

Trial court is directed to conclude the trial as early as possible.
