====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-02-2022 Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioners and Mr. Sadanand Paswan, learned Special Public Prosecutor for the State.

The two petitioners before this court are seeking extension of time to surrender and submit their respective bail bonds in terms of the order dated 17.04.2021 passed by learned predecessor Bench of this court in Cr. Appeal (SJ) No. 2146/2020. Learned counsel for the petitioners submits that they were granted privilege of anticipatory bail and as per direction of this court they had to surrender at least within a maximum period of eight weeks and furnish their bail bond but they failed to do it. A plea has been taken that due to non-participation of the Advocates in the court proceedings, under compelling

Patna High Court CR. MISC. No.44471 of 2021(2) dt.18-02-2022 2/2 circumstances the petitioners could not furnish their bail bond within the prescribed time.

This petition was filed before this court sometime in the month of July, 2021 and has been taken up for consideration today. Considering that the application was filed on behalf of the petitioners immediately after expiry of eight weeks period from 17.04.2021 and this application has remained pending before this court for about seven months, learned Special Public Prosecutor for the State has also not objected to the prayer for extension of time.

In the given circumstance, in the interest of justice, this court is extending the period. If the petitioners surrender and submit their bail bonds within two weeks from the date of communication of this order, the learned court below shall accept the same in terms of the order dated 17.04.2021 passed in Cr. Appeal (SJ) No. 2146/2020.
