JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State as well as learned counsel appearing on behalf of the informant.

The petitioner seeks bail in a case registered under Section 302 and other section of the Indian Penal Code. The petitioner is not named in the F.I.R. The name of the petitioner figured in the case on the basis of the Call Details Report.

Firstly, it is submitted that no evidence is collected against the petitioner. The petitioner belongs to the same village and the location of the mobile of the petitioner was found in the village. The petitioner did not talk with anybody at the relevant time.

On behalf of the informant, it is submitted that the

On consideration of the facts, it appears that the police, during the course of investigation, did not collect any tangible material to show the involvement of the petitioner in killing of the deceased Gaurav Kumar @ Sudama. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail in Surajgarha P.S.Case No. 75 of 2014 on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai.
