In this case, the petitioners are apprehending their arrest in connection with Bhabua (Sonhan) P.S. Case No. 756 of 2018 (G.R. No. 2670 of 2018) registered for offences under sections 147, 148, 149, 341, 323, 307, 354, 452, 379 of the Indian Penal Code.

In the present case, an allegation has been made that on 28.10.2018, the brother of the Informant was digging the soil for foundation, in the meantime, the accused persons came there and objected the same, when the Informant protested, the accused persons started to assault them.

Specific allegation has been made against Subash

Patna High Court Cr.Misc. No.80743 of 2018(2) dt.25-01-2019 2/2 Bind of causing injury on the head of the Informant by an iron rod.

Learned counsel for the petitioners submits that there is a land dispute between the parties and the petitioners have falsely been implicated in the present case. Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Mgistrate, Kaimur at Bhabua in connection with Bhabua (Sonhan) P.S. Case No. 756 of 2018 (G.R. No. 2670 of 2018), subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
