Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Punpun P.S. Case No. 74 of 2020, registered under Sections 447, 341, 323, 325, 379, 384, 504 and 506/34 of the Indian Penal Code.
The accusation is that informant, Munna Singh, engaged the labourers for cutting the Masur crop. At that time,
Patna High Court CR. MISC. No.32227 of 2020(2) dt.08-03-2021 2/2 both petitioner reached there and stop the labourers to cut the Masur crops. When the informant made protest then they all started to abuse. At that time, they caused injury through butt of pistol and rod causing blood oozing injury and they also snatched cash of Rs.10,000/- from his pocket. Learned counsel for the petitioners submits that, in fact, due to land dispute hot talk was exchanged in between both parties but informant with ulterior motive lodged the present case with false allegation. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Masaurhi at Patna, in connection with Punpun P.S. Case No. 74 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Bhardwaj/- (Rajendra Kumar Mishra, J) U T
