Heard the learned counsel for the petitioners as well as the learned counsel for the informant. The petitioners apprehend their arrest for the offences alleged under Sections 342, 323, 504, 506, 498(A), 313 and 379/34 of the Indian Penal Code, registered in connection with Jehanabad Mahila P.S.Case No.28 of 2020. It is a case of matrimonial dispute. As per allegation, the husband and his family members inflicted atrocities on the informant Niharika Kumari due to non-fulfilment of demand of
Patna High Court CR. MISC. No.43383 of 2021(2) dt.07-04-2022 2/3 dowry. There is also allegation against co-accused Mayank Kumar (husband) that he dashed the informant resulting in termination of her pregnancy.
At the very outset, the learned counsel for the petitioners has submitted that petitioner no.1 is cousin father-inlaw and petitioner no.2 is cousin mother-in-law of the victim. They are not concerned with the day-to-day affairs of the couple. He has submitted further that the father-in-law, motherin-law and brother-in-law of the victim have been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 28297 of 2021, vide order dated 15.06.2021. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned SDJM, Jehanabad in in connection with Jehanabad Mahila P.S.Case No.28 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided
