Learned counsel for the petitioner submits that the present writ petition has been filed with the following reliefs: "(i) To issue an appropriate writ/writs order/orders in the nature of mandamus for directing and commanding the respondents to grant ad-hoc promotion to the petitioner on the post of

Patna High Court CWJC No.8031 of 2026 dt.22-06-2026 2/3 Superintending Engineer/ Chief Engineer from the date of his juniors have been granted ad-hoc promotion with all consequential and financial benefits in pursuance to Government Resolution dated 11 September, 2002.

(ii) Any other relief or reliefs for which the petitioner is entitled on the facts and circumstances of the case."

Learned counsel for the State raised preliminary objection and submits that the petitioner has filed the present writ petition for issuance of mandamus and for which he has filed representations on 15.04.2026, which is annexed as Annexure- 5, on which no decision has been taken by the authority as yet. He submits that the representation is pending before respondent No. 2, the Secretary Road Construction Department, Govt. of Bihar, Patna.

In this view of the matter, this court without entering into merit or demerit of the case directs respondent No. 2, the Secretary Road Construction Department, Govt. of Bihar, Patna, to pass a reasoned and speaking order on the representation of the petitioner within 90 days from the date of receipt/production of a copy of this order. It is made clear that the petitioner shall be at liberty to supplement his representation.

5. With the aforesaid direction, this writ petition stands disposed off.
