====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 13-05-2025 Heard Mr. Gajendra Kumar Singh, learned counsel for the appellants and Mrs. Usha Kumari-1, learned Special Public Prosecutor for the State.
2. Learned counsel for the appellants fairly submits that the police after investigation submitted final form in favour of the appellants but the learned Court below differing with the final form has taken cognizance against the appellants in the present case.
3. Learned Special Public Prosecutor for the State submits that in view of the aforesaid, the anticipatory bail is not maintainable.

4. Learned counsel for the appellants submits that in view of the aforesaid, learned counsel for the appellants seek permission to withdraw the application with liberty to the appellants to surrender before the learned Court below within a period of two weeks from today and seeks regular bail.
5. Permission is accorded.
6. The application is dismissed as withdrawn with the liberty that the appellants surrender and seek regular bail before the learned Court below, the same shall be considered and disposed of on the same day, if possible, on its own merit in accordance with law and without being prejudiced by any observation in the present order.
