JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This is an application for grant of anticipatory bail in connection with Mahila P.S. Case No. 109 of 2016, disclosing offences under Sections 120(B), 354, 354(B), 447, 323, 504 of the Indian Penal Code.
Allegation as per F.I.R. is of outraging the modesty of the informant and the specific allegation against these petitioners is of assisting the other co-accused persons. Submission of learned counsel for the petitioners is that there is land dispute between the parties and earlier the informant had lodged a case before the DCLR under Section 16(3) of the Ceiling Act and being unsuccessful, she has lodged the present case against the petitioners.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga, in connection with Mahila P.S. Case No. 109 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
