JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, one culprit namely, Uttam Singh uttered the name of the petitioner at the time of alleged occurrence.

Submission on behalf of the petitioner is that the village of the petitioner is adjacent to the village of the informant but the informant has not claimed to have identified the petitioner at the time of alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.5850 of 2015 (6) dt.31-07-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Pranpur P.S.Case No. 11 of 2014.
