JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 18.10.2014 on the accusation that he was caught along with others while he as well as others assembled to make preparation for committing dacoity and on being searched, one country made pistol containing six live cartridges were recovered from his conscious possession. The contention on behalf of the petitioner is that petitioner was driver of the Bolero Jeep bearing Registration No. BR-O9R-0974 and as a matter of fact, some persons hired the aforesaid Bolero and while the aforesaid persons were being taken by the petitioner by the aforesaid Bolero, the said persons started fleeing after seeing the police party but petitioner and two others
Patna High Court Cr.Misc. No.10527 of 2015 (2) dt.13-03-2015 were arrested. It is further contended by him that petitioner does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Samastipur in connection with Sessions Trial No. 27 of 2015 arising out of Tajpur P.S. Case No. 351 of 2014.
