JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner though misappropriated the amount appertaining to Rs.2,70,000/-, however, appears to be ashamed and pleaded that whole amount will be returned by him and for that, has asked for some sort of relaxation in order to manage the amount.
Accordingly, petitioner Anand Alexander is directed to be released on provisional bail after depositing the first instalment of Rs.50,000/-, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Mufassil P. S. Case no.655 of 2013, for a period of six months whereunder the
Patna High Court Cr.Misc. No.44940 of 2014 (03) dt.02-04-2015 remaining amount be deposited either in lump sum or in instalment. To have appearance of petitioner during midst thereof, it looks desirable to direct that one of the bailors should be a government servant. In the event of deposit of remaining amount Rs.2,20,000/- within six months, then in that event, the learned lower Court will confirm the provisional bail otherwise the privilege of provisional bail will vanish after expiry of the period of six months. The deposit will not be treated admission during course of trial.
