====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

The informant alleges that his daughter all of a sudden on 20.11.2021 disappeared from his relatives place, further on 28.11.2021, he received a call from his daughter who disclosed that she was kidnapped by the petitioner and is being sexually exploited, thereafter, someone snatched the phone and started assaulting her.

Learned counsel for the petitioner submits that the

No.33906 of 2022(2) dt.28-11-2022 2/3 petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that petitioner and the victim were in love and thus fled away and even got married. Learned counsel next submits that falsity of the allegation also manifest that the date of occurrence was 20.11.2021 that is the date on which the informant came to know about the occurrence but then the FIR instituted on 1.12.2021, it is further submitted from perusal of the order impugned it would manifest that the same records that the victim in her statement before the police has clearly stated that she on her own volition had left with the petitioner and they have performed marriage in a temple and she is a major as her date of birth is 10.03.2001 Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/-
