JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Dighwara P.S. Case No. 145 of 2017, disclosing offences under Sections 420, 467, 468, 406 and 506 of the Indian Penal Code.
Initially the complain petition was filed by the complainant, which was subsequently sent to the concerned police station for registration of F.I.R. under Section 156(3) of the Cr.P.C. and the allegation as per complaint petition is that the petitioner executed a sale deed in favour of the informant in the year 2016 and when the informant went to get the land mutated, she came to know that the land is in the name of some other person and when she went to the petitioner and demanded her money but the petitioner refused to pay the money. Patna High Court Cr.Misc. No.1438 of 2019(2) dt.22-01-2019 2/2 that the land in question was purchased by the petitioner in the year 1986 and since then, he was in peaceful possession of the said land and there is no fraud committed by the petitioner and has falsely been roped in the present case by the informant with ill motive. Moreover, the case is purely of civil nature. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Saran at Chapra in connection with Dighwara P.S. Case No. 145 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
