2. The petitioner apprehends his arrest for the offences alleged under Section498(A) of the Indian Penal Code registered in connection with Complaint Case No. 403/2024.
3. The marital discord between the couple has given rise to the present litigation.
4. For exploring the possibility of amicable settlement of the dispute between the parties, the matter was referred to the Patna High Court Mediation and Conciliation Centre. Both the parties have compromised the case and the memorandum of agreement is annexed with the Mediator's report dated 24.09.2025.
5. The learned counsel for the petitioner submits that, according to the terms and condition of the agreement, the
Patna High Court CR. MISC. No.33174 of 2025(4) dt.03-12-2025 2/2 petitioner has paid the entire amount of Rs. 7,50,000/- to o.p.no.2 and the first motion of the divorce case being Matrimonial Case No. 220/2023 filed under Section 13B of the Hindu Marriage Act, 1955 has completed.
6. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, East Champaran at Motihari in connection with Complaint Case No. 403/2024.
7. The O.P.No.2 is directed to adhere to her word and withdraw the Matrimonial Case No. 220/2023 within a period of one month.
