The petitioner is not named in the first information report and admittedly, in course of investigation, the stolen vehicle was recovered, for which, Bhaktinagar (Jalpaiguri) P.S. Case No. 1208 of 2014 was registered and in the aforesaid case, the petitioner was made accused.

The contention on behalf of the petitioner is that the seized vehicle was recovered from the house of co-accused, Kelwin Thumpi @ Thumpi Raj and the petitioner was only residing in the house of said Kelwin Thumpi @ Thumpi Raj Moreover, the petitioner has already been released on bail in connection with Bhaktinagar (Jalpaiguri) P.S. Case No. 1208 of 2014.

Patna High Court Cr.Misc. No.7000 of 2015 (2) dt.26-02-2015 2/2 Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Suryagarha P.S.
