The petitioner is languishing in custody since 03.02.2015 in a case registered for the offences punishable under Sections 25(1-B)/26/35 of the Arms act and 3/4 of Explosive Substances Act.

From co-accused Kasim Ansari country made gun was recovered whereas from the cowshed in front of the house of the petitioner country made bombs were recovered. It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner, but for the recovery made on 11.12.2014 the FIR was registered on 13.12.2014 when the FIR was reached to the

Patna High Court Cr.Misc. No.13053 of 2015 (02) dt.03-04-2015 2/2 learned court below on 15.12.2014.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui in connection with Khaira P.S.
