The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code. As per the prosecution case, the allegation against all the accused persons including the petitioner is that they have assaulted the informant, his wife and his son by means of iron rod and sword causing injury to them.

Learned counsel for the petitioner submits that the injuries allegedly caused are said to be simple in nature. The petitioner has got clean antecedent. There is land dispute between the parties and there is also a case and counter case. The co-accused have been granted bail by the Coordinate Bench

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIth, Saran at Chapra in connection with Awatar Nagar P.S. Case No. 06 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
