JUSTICE MADHURESH PRASAD ORAL ORDER 20-12-2018 Heard learned counsel for the petitioners as well as learned counsel for the State.
Petitioners apprehend arrest in a case registered for offence under sections147, 148, 149, 341, 323, 386, 353, 427,504 and 506 of the Indian Penal Code.
It is submitted on behalf of the petitioners that the informant is the branch manager of a private construction company for construction of National Highway between Bhojpur to Buxar. Petitioners are alleged to have obstructed the
Patna High Court Cr.Misc. No.75036 of 2018(2) dt.20-12-2018 2/2 work though no specific allegation of any overt act is alleged against them. Petitioners were in fact making peaceful demand of compensation which is still pending before the Government authorities. Prior to the instant case, there is no criminal antecedent of the petitioners.
Considering the aforesaid submissions and the facts and circumstances of the case, prayer for bail to the petitioners is allowed. In the event of arrest/surrender within four weeks from today, Let all the six petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Brahampur Police Station Case No. 454 of 2018 on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
