The petitioner is languishing in custody since 28.01.2015 in a case registered for the offences punishable under Sections 341 and 307/34 of the Indian Penal Code. It is alleged by the informant being the victim that she was caught by this petitioner and his mother Fudo Devi when the victim went to collect due money and the wife of the petitioner, Rita Devi lit the fire.
It is submitted by learned counsel for the petitioner that in subsequent statement recorded in paragraph 17 of the case diary the victim has not levelled accusation against this petitioner as she has only levelled accusation against the mother
Patna High Court Cr.Misc. No.13164 of 2015 (03) dt.01-05-2015 2/2 and wife of this petitioner.
This fact has not been controverted by the learned APP after going through the case diary and the investigation has already concluded.
Considering the subsequent statement of the victim, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 28 of 2014.
