JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-07-2019 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Sonepur Police Station Case No. 217 of 2018, disclosing offences under Sections 304B/498A/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961.

The allegation against the petitioner along with other co-accused is that they assaulted the deceased in the abdomen and due to which, she died.

Learned Counsel for the petitioner submits that the petitioner is the Gotni of the deceased and father-in-law, motherin-law and husband of the deceased have been granted bail by the learned Court below as well as by this Court. The father-in-

Patna High Court CR. MISC. No.33544 of 2019(2) dt.10-07-2019 2/3 law of the deceased has been granted regular bail by the Court below by order, dated 10.06.2018, passed in B. P. No. 774 of 2018; whereas mother-in-law and husband of the deceased have been granted anticipatory bail by this Court, vide order, dated 18.09.2018, passed in Criminal Misc. No. 48326 of 2018. After having heard learned Counsel for the parties and taking into consideration the fact that father-in-law, motherin-law and husband of the deceased have been granted bail and the petitioner is the Gotni of the deceased, this application is allowed.

Let the petitioner, Priyanka Devi, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, t Chapra, in connection with Sonepur Police Station Case No. 217 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail

Patna High Court CR. MISC. No.33544 of 2019(2) dt.10-07-2019 3/3 bond shall be liable to be cancelled.
