Petitioners seek pre-arrest bail in Paras Bigha P.S.Case No.149/18 registered under Sections 341, 323, 307, 504 and 506/34 of I.P.C.
Allegation against the petitioners and others is of assault to the informant and his grand daughter and getting his paddy crops uprooted by someone.
Submission on behalf of the learned counsel for the petitioners is that there is land dispute which appears from the F.I.R. itself. There is case and counter case between the parties and injuries are simple in nature.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1326 of 2019(2) dt.18-01-2019 2/2 circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of Sri P.K.Bharti, J.M., 1st Class, in Jehanabad, in Paras Bigha P.S.Case No.149 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
