Heard the parties in virtual Court.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act,2018. The petitioner had lodged Hariharganj P.S.Case No.08 of 2020 relating to theft of his motorcycle bearing Registration No.JH03N2578 on 02.02.2020. A copy of the FIR is at Annexure-2. From the same vehicle, liquor was recovered on 18.06.2020.

Considering the facts aforesaid, let the petitioner, above named, who has got no criminal antecedent, in the event of his arrest or surrender before the court below within a period

Patna High Court CR. MISC. No.43208 of 2021(2) dt.17-12-2021 2/2 of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kutumba P.S.Case No.98 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as subject to the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Nitesh/- U T
