The petitioner seeks bail in a case instituted for the offences under Sections 302 and 120B of the Indian Penal Code and 27 of the Arms Act.

Earlier this Court vide order dated 20.3.2014 passed in Cr. Misc. No.43842 of 2013 rejected the prayer for bail of the petitioner with a liberty to renew his prayer for bail after framing of charge.

Learned counsel for the petitioner submits that charge has been framed in the present case and petitioner is in jail since 11.9.2013.

There is an allegation against the petitioner that he has

Patna High Court Cr.Misc. No.45765 of 2014 (4) dt.21-01-2015 given direction to kill the victim.

In view of nature of allegation and period of custody, let petitioner, Ramji Rai, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. II, Buxar in S.T. No.350 of 2013, arising out of Simari P.S. Case No.150 of 2013, subject to the conditions that petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
