The petitioner is apprehending his arrest in connection with Complaint Case No.CA 1552 of 2018 registered for offences punishable under Sections 498(A) of the Indian Penal Code.

Allegation against the petitioner is of subjecting his wife of cruelty and harassment in spite of demand of Rs.05 lac and one car.

Learned counsel for the petitioner has drawn my attention towards annexure 2 which is the court of police family reconciliation centre and try to show that it is the complainant who is at fault and insisting for living in her Maike and the

Patna High Court Cr.Misc. No.1716 of 2019(2) dt.01-02-2019 2/2 petitioner is at no fault and he is still ready to keep her. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order and on surrender he will be released on bail in connection with Complaint Case No.CA 1552 of 2018 to his own satisfaction for the period of three months, in the meantime the leanred court below shall issue notice to the O.P.no.2 (wife) to appear and to make efforts for reconciliation and after reconciliation if it s found that the petitioner is at no fault and he is ready to keep her, his will confirm the bail bond of the petitioner; otherwise he is free to pass any other order or orders as he deems fit and proper.

With the aforesaid observation, this application is disposed of.
