Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Excise P.S. Case No. 11 of 2011, registered for the offence punishable punishable under Section 47(a)(f) of the Bihar Prohibition and Excise Act, 2016. 20 litres of country made liquor, 300 Kg of Jawa Mahua and apparatus for making wine has been recovered from house of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from the house which is in joint possession of family. Petitioner

Patna High Court CR. MISC. No.43201 of 2021(2) dt.29-10-2021 2/2 is in custody since 10.03.2021. Investigation is complete. Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise, Gaya in connection with Excise P.S.
