The petitioner is in custody since 24.11.2014 in connection with Phulwaria P.S. Case No.116 of 2014 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that one coaccused Chhotu Jha, who was arrested by the police, has taken the name of the petitioner in his confessional statement, which has no evidentiary value. Learned counsel for the petitioner further submits that statement of the victim Sonu Kumar was recorded under Section 164 of the Cr.P.C., but he did not take the name of this petitioner. Patna High Court Cr.Misc. No.11672 of 2015 (3) dt.26-05-2015 2/2 was arrested, has since been released on bail by a Bench of this Court in Cr.Misc. No.6993 of 2015, vide order dated 28.4.2015. Considering the aforementioned submissions, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Deopriya Kumar, learned Judicial Magistrate,1st Class, Begusarai, in connection with Phulwaria P.S. Case No.116 of 2014.
