02. In the present case, the petitioner is apprehending his arrest in connection with Madhuban P.S. Case No. 151 of 2017 registered for the alleged offences under Section 188, 143, 147, 148, 341, 323, 324, 325, 353, 307, 504, 506 and 120(B) of the Indian Penal Code.

03. As per prosecution case, due to accidental death of a boy, the petitioner and other co-accused persons numbering 200300 obstructed the traffic and created problem of law and order. They also assaulted the police party with lathi, danda, brick etc. and tried to snatch firearms from the police personnel who received injuries in this assault.

04. Learned counsel for the petitioner submits that the

The petitioner was not apprehended from the spot and nothing incriminating has been recovered from his person or possession though there is allegation of assault but no injury report has been brought on record till date. The petitioner was not even present at the place of occurrence and it is a case of out and out false implication. A number of co-accused persons have been granted anticipatory bail by different Co-ordinate Benches of this Court vide order dated 30.08.2023 passed in Cr. Misc. No. 52034 of 2023, order dated 01.12.2023 passed in Cr. Misc. No. 75262 of 2023 and order dated 30.04.2025 passed in Cr. Misc. No. 23026 of 2025. The case of the petitioner is similarly placed. The petitioner is having clean antecedent.

05. Learned A.P.P. for the State opposes the submission made on behalf of the learned counsel for the petitioner. Learned A.P.P. submits petitioner and others interfered with the police work.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the general and vague nature of allegation against the petitioner and further considering possibility of false accusation, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be

No.32019 of 2025(2) dt.20-05-2025 3/3 released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of Court of learned Sessions Judge, East Champaran, Motihari in connection with Madhuban P.S. Case No. 151 of 2017 of 2024, subject to the condition laid down under Section 482(2) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
