In this case, the petitioner is seeking anticipatory bail in connection with Bhagwan Bazar P.S. Case No. 511 of 2019 registered for offence punishable under sections 147, 447, 323, 324, 307, 379/34 of the Indian Penal Code.

In the allegation, it has been specifically mentioned that the petitioner assaulted the victim by sword. Learned counsel for the petitioner submits that one Joshi Kumar has been granted anticipatory bail by one of the coordinate Bench of this Court in Cr. Misc. No. 17979 of 2020, but so far in the present case, specific allegation has been made against the petitioner to have assaulted the victim by sword. Looking to the facts and circumstances of the case,

Patna High Court CR. MISC. No.32812 of 2020(2) dt.09-03-2021 2/2 this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below, the court below without being prejudiced by this order will take decision in accordance with law.
