JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-02-2021 Heard Mr. Gagan Deo Yadav, learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Pandaul P.S. Case No. 72 of 2020 dated 04.07.2020 instituted for the offences under Sections 341, 323, 308, 379, 506 and 34 of the Indian Penal Code. Though in the F.I.R, there is case against the petitioners is of having assaulted the informant and his wife but the injuries suffered by the them have been opined to be simple in nature. There is counter version of the occurrence
Patna High Court CR. MISC. No.32924 of 2020(2) dt.22-02-2021 2/2 also, in which, the petitioners stood injured. This fact has not been mentioned in the F.I.R., making the accusation in the said F.I.R. absolutely doubtful. Considering the aforesaid facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 72 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
