The name of petitioner came in the statement of victim recorded u/S 164 of the Cr.P.C. but in his statement, the victim specifically, stated that he came to know about the name of petitioner and his kidnappers on the basis of conversations of the culprits. Moreover, having similar allegation, one co-accused, Raushan Kumar Sinha @ Raushan Lala @ Putus has already been granted privilege of bail and the petitioner is languishing in jail custody since long having no criminal antecedent.
