JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.12.2014 in a case registered for the offences punishable under Sections 20,22,23 and 24 of the NDPS Act.

The accusation is of recovery of 100 grams of smacks from the possession of co accused Lal Mian. The petitioner is named in the FIR on the confession of Lal Mian. It is submitted by the learned counsel for the petitioner that even assuming the accusation no recovery has been made from the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named
