The petitioners seek bail in anticipation of their arrest in connection with Chandauti P. S. Case No. 182 of 2018 dated 9.08.2018 instituted for the offences under Sections 341, 323, 324, 328, 379, 307, 354, 504, 506 and 34 of the Indian Penal Code.

In a dispute between two parties, the petitioners

Patna High Court Cr.Misc. No.956 of 2019(3) dt.11-02-2019 2/3 are alleged to have assaulted Babli Devi and Bindiya Devi who are related to the informant. The assault is said to have been made by hard and blunt substance on vital portion of the body, namely, the head.

Learned counsel for the petitioners has submitted that an absolutely false case has been lodged against the petitioners and others.

There is a counter version of the occurrence as well.

The dispute arose because of the attempt of the informant to carry out construction over gair mazarua aam land.

The injuries suffered by the two ladies who are alleged to have been assaulted by the petitioners have been opined to be simple in nature.

Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail

Patna High Court Cr.Misc. No.956 of 2019(3) dt.11-02-2019 3/3 bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.
