Petitioner is languishing in custody since 21.11.2014 in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. It is alleged that for dispute with regard to taking money for buying liquor the petitioner took the daughter of the informant (wife) near the embankment of the river and strangulated her.
Learned counsel for the State submits that postmortem report supports the accusation. It is submitted by the learned counsel for the petitioner that ligature mark has been found around the neck which suggests that victim was not strangulated. Considering the nature of accusation, this Court
Patna High Court Cr.Misc. No.13209 of 2015 (3) dt.30-06-2015 is not inclined to grant bail to the petitioner in connection with Baniyapur P.S. Case No. 227 of 2014 pending in the Court of learned Judicial Magistrate, Ist Class, Saran at Chapra. Accordingly, the bail application stands dismissed.
